Luxury Concrete Coating LLC (“Company,” “we,” “our,” or “us”) provides this website and its services subject to the following Terms and Conditions. By accessing our website, requesting an estimate, or engaging our services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

1. Services Provided
Luxury Concrete Coating LLC provides concrete coatings, flooring solutions, and related services as described on our website or in estimates issued to customers. All services are subject to written estimates and agreements.

2. Estimates and Proposals
• All estimates are valid for 60 days unless otherwise noted.
• Estimates are based on information provided by the Customer and assume normal site conditions.
• Any additional work outside the scope of the estimate (e.g., removal of tree roots, reinforcing steel, utilities, hidden debris, or other obstructions) will require a written change order with adjusted pricing and schedule.

3. Pricing and Payment
• Payment terms will be specified in each estimate. Unless otherwise stated:
• 50% deposit is due upon acceptance of estimate.
• 50% balance is due upon completion of work.
• Once mobilization occurs (labor, equipment, or materials allocated to the project), 20% of the deposit is non-refundable.
• Payments not received when due may accrue interest at 1.5% per month (18% annually).
• We reserve the right to suspend or terminate work if payments are not made according to schedule.

4. Site Conditions and Access
• Customer shall provide clear access to the work area, including removal of vehicles, equipment, or other obstacles.
• Customer is responsible for coordinating utility locates (811 or private locate) before work begins. We are not responsible for damage to unmarked or inaccurately marked underground utilities, electrical conduit, plumbing, or other obstructions.
• Work may generate dust, noise, slurry, or vibration. While reasonable precautions will be taken, Customer is responsible for protecting adjacent property, landscaping, and finishes.

5. Concrete and Structural Disclaimer
• We are not responsible for cracking, chipping, spalling, or other damage to existing concrete caused by structural weakness, pre-existing defects, edge proximity, or hidden voids.
• We are not responsible for cosmetic appearance of surrounding concrete, including chips or exposed aggregate around drill holes.
• Customer acknowledges that drilling and coating over compromised substrates may result in reduced performance, for which we are not liable.

6. Change Orders
• Any additional work required outside the original scope will be documented through a change order.
• Examples include: tree root removal, rebar cutting/removal, underground obstructions, rock, poor substrate conditions, or requests for added services.
• Change orders must be signed or approved electronically by the Customer before work proceeds.

7. Warranties
• Workmanship is warranted to be performed in a professional manner consistent with industry standards.
• No warranty is provided for:
• Work performed against Contractor recommendations.
• Damage caused by misuse, abuse, neglect, accidents, or lack of maintenance.
• Issues arising from site conditions beyond our control (ground movement, drainage issues, substrate failure, or hidden defects).
• Product-specific warranties may apply if provided by the manufacturer; these will be passed through to the Customer.

8. Limitation of Liability
• Contractor maintains liability insurance and will provide proof upon request.
• Contractor shall not be liable for incidental, indirect, or consequential damages, including loss of use, business interruption, or lost profits.
• Customer’s sole remedy for defective work shall be repair or replacement, at our discretion.

9. Delays
We are not responsible for delays caused by weather, site inaccessibility, supply chain disruptions, unmarked utilities, or other factors outside our control. If delays occur, schedules may be adjusted without penalty.

10. Intellectual Property
All content on our website, including text, images, logos, and designs, is the property of Luxury Concrete Coating LLC and may not be copied, distributed, or used without our prior written consent.

Use of our website is also governed by our Privacy Policy, available on our website.

12. Accessibility

13. Termination
Either party may terminate the Agreement in the event of a material breach by the other party. Upon termination, Customer shall pay for all work completed up to the termination date. Deposits will be refunded in accordance with Section 3, less any non-refundable amounts.

14. Governing Law
These Terms and Conditions shall be governed by and construed under the laws of the State of Ohio. Any disputes shall be subject to the jurisdiction of courts located in Ohio.

15. Entire Agreement
These Terms, together with any estimate, proposal, or signed agreement, constitute the entire understanding between Contractor and Customer. No oral statements or promises not contained herein shall be binding.
